La globalización se extiende en la actualidad mucho más allá de los ámbitos de la economía y de las finanzas, y con ello se traspasan no sólo fronteras nacionales sino también socio-culturales. Esto hace necesario preguntar cómo deben comportarse las estructuras jurídicas frente a las personas provenientes de estructuras jurídicas diferentes: ¿Existe un derecho penal intercultural? ¿Es ilegítima, desde el punto vista ético-jurídico, una competencia penal que desconoce las pertenencias culturales? En la medida en que la globalización amenaza un elemento indispensable para el ser humano y la formación de una identidad personal -a saber, la pertenencia a determinadas culturas, religiones o tradiciones-, estas cuestiones se tornan tanto más urgentes. Sin embargo, en la medida en que la penalización del delito puede ser fundamentada con ayuda de una idea universalista de los derechos humanos también existen buenas razones morales para la existencia de un derecho penal intercultural.
At present, globalisation reaches many other fields than economy and finance. Due to this fact, not only national but also socio-cultural boundaries have been surpassed. Thus, it becomes necessary to question how should judicial structures behave in relation to people whose judicial structures are different. Does an intercultural penal right exist? Will it be considered illegal, from a judicial-ethic point of view, a faculty of penalisation, which doesn’t take into consideration cultural belongings? As long as, globalisation threatens such an indispensable constituent for the human being as well as for the building of a personal identity - such as, the belonging to specific cultures, religions or traditions - these issues become more urgent to deal with. However if the penalising of the crime can be supported by the help of an universalist idea regarding human rights, there will also exist good universal moral reasons for the existence of an intercultural penal right.
Die Globalisierung geht heute weit über die Bereiche Wirtschaft und Finanzen hinaus. Nicht nur staatliche, auch gesellschaftlich-kulturelle Grenzen werden überschritten. Das macht die Frage notwendig, wie sich Rechtsordnungen gegenüber Personen aus andersartigen Rechtsordnungen verhalten sollen: Gibt es ein interkulturelles Strafrecht? Ist eine Strafbefugnis rechtmoralisch legitim, die über kulturelle Zugehörigkeiten hinwegsieht? Derartige Fragen sind um so dringlicher, als die Globalisierung ein Element bedroht, das für das Menschsein und die Ausbildung einer personalen Identität unverzichtbar ist: die Zugehörigkeit zu bestimmten Kulturen, Religionen oder Traditionen. Doch insofern die Bestrafung von Unrecht mit Hilfe einer universalistischen Idee der Menschenrechte begründet werden kann, gibt es auch gute moralische Gründe für die Existenz eines interkulturellen Strafrechts.
