Este artículo analiza el cumplimiento de la Carta Social Europea a través del organismo del Comité Europeo de Derechos Sociales, órgano no jurisdiccional. Este órgano ha visto incrementada su importancia gracias al Protocolo Adicional, que permite la posibilidad de interponer reclamaciones colectivas a partir de las cuales el CEDS presenta informes vinculantes con recomendaciones a los Estados. España ratificó la CSE en mayo de 2021 y el Protocolo Adicional en octubre de 2022, por lo que este trabajo analiza el impacto real de las decisiones del CEDS y cómo está influyendo en la práctica jurisdiccional, donde se está llegando a producir un control de convencionalidad difuso.
This article analyzes compliance with the European Social Charter through the body of the European Committee of Social Rights, a non-jurisdictional body. This body has seen its importance increase thanks to the Additional Protocol, which allows for the possibility of filing collective complaints on the basis of which the CEDS submits binding reports with recommendations to the States. Spain ratified the SSC in May 2021 and the Additional Protocol in October 2022, so this paper analyzes the real impact of the decisions of the ECtHR and how it is influencing the jurisdictional practice, where a diffuse control of conventionality is taking place.
