El siguiente trabajo representa quizá si el primer análisis sistemático y global de las principales reformas introducidas a la legislación laboral por el actual gobierno. Tales reformas tuvieron lugar entre los años 1979 y1982 y tienen un alcance que desborda ampliamente el ámbito del análisis jurídico-legislativo. El propósito que fundamentalmente las animó fue compatibilizar el funcionamiento del mercado laboral con el esquema de una economía social de mercado y con un modelo libre de desarrollo. Entre otros temas, el trabajo profundiza en la naturaleza de la relación laboral, en las implicaciones que tienen las indemnizaciones por despido, en las características de la organización sindical según la nueva normativa y en las bases que ella establece para la negociación colectiva. Cada uno de estos temas ha sido escenario de controversias, pero está al margen de dudas que la modernización promovida en este plano por el actual régimen ha modificado aspectos sustantivos de la sociedad chilena. Al mismo tiempo, ha incorporado al debate sobre estos temas conceptos, relaciones y valores tradicionalmente excluidos del análisis de la institucionalidad laboral del país.
This paper represents what is possibly the first systematic and globalanalysis of the principal reforms to labor legislation introduced by thecurrent government. These reforms took place between 1979 and1982 and their scope extends far beyond the range of judicial-legisla-tive analysis. The fundamental motive for the reforms was to makethe working of the labor market compatible with the framework of asocial market economy and a liberal development model. Among theissues discussed, the paper gives details regarding the nature of thelabor relationship, the implications of redundancy payments, thenature of union organization in the light of the new rules and the basesthese lay for collective bargaining. Each of these issues has been thescene of controversy, but there can be no doubting that the moderni-zation promoted in this plan by the current regime has changedsubstantial aspects of Chilean society. At the same time, it has intro-duced into the debate on these issues, concepts, relations and valuesthat have traditionally been excluded from the analysis of the institu-tional framework of the national labor market.
