In the essay, the author analyses the two requested referendum aimed at repealing the existent legal regulation of dismissals. In the author’s opinion, both requests, subject to a preliminary judgment of admissibility by the Constitutional Court, should be declared admissible. As to the alleged usefulness of the referendum aimed at repealing the entire Legislative Decree No. 23/2015, in the author’s view, despite the amendments already made to it by a number of rulings of the Constitutional Court, there are good reasons for definitely removing such a regulation of dismissals, that continues to be a source of unequal treatment and weakening of the protection of employees.
