El presente artículo analiza la película italiana “Yo capitán” a la luz de la normativa internacional en materia de tráfico ilícito de migrantes. Se analizará el Protocolo contra el Tráfico Ilícito de Migrantes por Tierra, Mar y Aire −conocido como Protocolo de Palermo−, especialmente la definición de tráfico ilícito de migrantes cristalizada en el mismo y los hechos que surgen del largometraje. Esta galardonada película que narra el viaje de dos primos senegaleses que deciden emigrar de forma irregular a Europa se inspiró en una historia real, la de Amara Fofana: un adolescente de 15 años sin ninguna experiencia en navegación que fue seleccionado por unos traficantes para capitanear un barco con 250 personas a bordo rumbo a Europa. Es esta travesía marítima la que se tomará como eje central para desarrollar el presente trabajo académico, que –como ya se señaló– tiene como principal objetivo determinar el alcance de la definición de “tráfico ilícito de migrantes” contenida en el Protocolo de Palermo.
This article analyzes the Italian film “Io capitano” ("I, captain") using the international regulations on migrant smuggling. We will look at the Protocol against the Smuggling of Migrants by Land, Sea and Air − also known as the Palermo Protocol −, particularly at the definition of smuggling of migrants adopted in it and at the facts arising from the film. This award-winning film narrating the journey embarked on by two Senegalese cousins who decide to emigrate illegally to Europe is based on a true story: the story of Amara Fofana, a 15-year-old teenager with no sailing experience who was chosen by traffickers to skipper a boat carrying 250 people to Europe. It is this sea journey that we will focus on to carry out this academic work, whose aim – as pointed out before – is to determine the scope of the definition of “migrant smuggling” included in the Palermo Protocol.
