: El contrato de alimentos puede constituir una vía para vaciar el caudal hereditario, generando un perjuicio a las legítimas como resultado de la transmisión del capital por el cedente en favor del alimentante. La onerosidad del contrato constituye un límite a la efectividad de la invocación de una vulneración por los legitimarios, por lo que no será declarada su nulidad por acto en fraude, salvo cuando se pruebe la gratuidad del negocio y la ausencia de una causa que responda a la función típica asistencial para la que se previó esta figura contractual en la Ley 41/2003.
The maintenance contract may constitute a means of emptying the estate, generating a detriment to the legitimate rights as a result of the transfer of the capital by the transferor in favour of the provider. The onerous nature of the contract constitutes a limit to the effectiveness of the invocation of an infringement by the legitimated beneficiaries, which is why it will not be declared null and void for fraud, except when the gratuitousness of the business and the absence of a cause that responds to the typical welfare function for which this contractual figure was envisaged in Law 41/2003 is proven.
