El principio de seguridad jurídica reclama la mayor estabilidad posible del ordenamiento jurídico, pero no puede impedir el cambio normativo. Con todo, una mejor técnica legislativa facilitaría una mayor estabilidad de las normas. La Constitución prohíbe la retroactividad de las normas restrictivas de derechos individuales, cuyo alcance debe ser precisado. En todo caso, no deben considerarse retroactivas las normas que solo se aplican hacia al futuro, aunque incidan en relaciones o situaciones jurídicas nacidas en el pasado. La cuestión es cuándo el cambio normativo lesiona derechos consolidados y situaciones jurídicas protegidas, lo que debe ser decidido en cada caso. El cambio normativo puede dar lugar a daños antijurídicos, lo que desencadenaría la correspondiente responsabilidad extracontractual de la Administración.
