El presente artículo discute sobre la autonomía de los órganos persecutores del delito en México. Se plantea que la autonomía reconocida formalmente no se ha visto reflejada en independencia política, ya que las nuevas fiscalías continúan trabajando como órganos políticos del gobierno en turno. Esto impide que estos órganos puedan fungir como auténticos garantes del derecho de acceso a la justicia. Se sostiene la necesidad de promover cambios en la cultura institucional, para concebir las funciones de investigación y persecución de delitos como estrictamente técnico-jurídicas y dotar a los fiscales de las mismas garantías de independencia que corresponden a los jueces.
The article discusses the autonomy of the criminal prosecution bodies in Mexico. It argues that the formally recognized autonomy has not been reflected in political independence since the new prosecutors’ offices continue to work as political bodies of the government in power. This situation prevents these bodies from acting as authentic guarantors of the access to justice right. The article argues that it is necessary to promote changes in the institutional culture, in order to conceive the functions of investigation and criminal prosecution as strictly technical-legal and to provide prosecutors with the same guarantees of independence that correspond to judges.
