A decision on constitutionality by the Italian Constitutional Court has again been required by that Court for a legislative act that conflicts with a rule of EU law having direct effect to be discarded: this at least when the question of constitutionality is raised as a principal case. The Court’s view is not only at odds with the jurisprudence of the Court of Justice, but is also incoherent.
