    Los casos de acumulación de sanciones penales y administrativas por un mismo hecho, cuya legitimidad ha sido cuestionada por la jurisprudencia principalmente desde la perspectiva de la prohibición de bis in idem, han aumentado significativamente en las últimas décadas. En agosto de 2023, la Ley 21.595 incorporó un nuevo artículo 78 bis al Código Penal, norma cuyo objeto es regular la acumulación o compatibilidad de sanciones penales y administrativas respecto de un mismo hecho. Este trabajo tiene por objeto analizar la aplicación de la prohibición de sanción múltiple en Chile, con especial referencia al nuevo artículo mencionado.

    In recent decades, there has been a significant increase in cases of cumulation of criminal and administrative sanctions for the same facts. Courts have questioned the legitimacy of these systems of sanctions, mainly from the perspective of the prohibition of bis in idem. In August 2023, Law 21.595 introduced a new Article 78 bis into the Criminal Code, which aims to resolve the problem of the cumulation of criminal and administrative sanctions for the same facts. The purpose of this article is to analyze the application of the prohibition of multiple sanctions in Chile, with particular attention to the new Article mentioned.
