El subsidio por incapacidad temporal es una de las prestaciones que se reconocen con más frecuencia en el ámbito de la acción protectora del Régimen General de la Seguridad Social y cuyo derecho se desarrolla, en la mayoría de los casos, de forma prolongada. Al tratarse de una prestación que tiene su origen en una incapacidad para el trabajo, su nacimiento está condicionado médicamente; su duración depende del mantenimiento o no de las causas médicas que determinaron su reconocimiento, y la continuación en el derecho puede estar afectada por la actuación del propio beneficiario; y su extinción finaliza, preferentemente, por la desaparición de aquellas causas. Además, dicho desarrollo está también condicionado al cumplimiento de diferentes requisitos procedimentales, como es la emisión de los diferentes partes médicos. Así, el objetivo de este trabajo es reflejar, y, por qué no, ordenar las normas que regulan la dinámica del derecho a la prestación por incapacidad temporal, matizándolas con la interpretación que ha venido realizando tanto los tribunales como la propia Administración de la Seguridad Social.
The temporary disability benefit is one of the most frequently recognized benefits within the scope of the protective action of the General Social Security Regime and whose entitlement is developed, in most cases, on a prolonged basis. Since it is a benefit that has its origin in an inability to work, its origin is medically conditioned; its duration depends on the maintenance or not of the medical causes that determined its recognition, and the continuation of the right can be affected by the actions of the beneficiary himself; and its extinction ends, preferably, by the disappearance of those causes. Furthermore, this development is also conditioned by the fulfillment of different procedural requirements, such as the issuance of the different medical reports. Thus, the aim of this paper is to reflect, and, why not, to order the rules that regulate the dynamics of the right to the temporary disability benefit, qualifying them with the interpretation that has been made both by the courts and the Social Security Administration itself.
