El trabajo analiza la iniciativa legislativa popular en la Comunitat Valenciana, comenzando con una introducción sobre su naturaleza y la regulación inicial establecida en la Ley 5/1993. Posteriormente, se examinan las novedades incorporadas en su reemplazo, la Ley 10/2017, que sigue vigente. El artículo profundiza en estas novedades y aborda, desde una perspectiva práctica, los problemas surgidos en su aplicación, centrados en cuatro aspectos clave: la legitimación activa para presentar la iniciativa, la recogida de firmas, la tramitación parlamentaria de la proposición de ley y la compensación de gastos a la Comisión Promotora.
The paper analyzes the popular legislative initiative in the Valencian Community, starting with an introduction on its nature and the initial regulation established in Law 5/1993. It then examines the innovations introduced by its replacement, Law 10/2017, which remains in force. The article delves into these innovations and addresses, from a practical perspective, the problems that have arisen in its application, focusing on four key aspects: the active legitimation for submitting the initiative, the collection of signatures, the parliamentary processing of the legislative proposal, and the reimbursement of expenses to the Promoting Committee.
