El reconocimiento constitucional del derecho al trabajo conlleva, entre otros aspectos, a la consideración de la colocación como actividad o servicio público. Ello no obsta a que tal actividad se preste tanto en sus formas de gestión directa -a través de los servicios públicos de empleo estatales o autonómicos- o de forma indirecta -mediante el recurso a la iniciativa privada-, y todo ello presidido por el principio de colaboración con lo público. Tal relación de cooperación entre sujetos intervinientes en la actividad de la intermediación parte en la nueva Ley 3/2023, de Empleo, en todo caso, del fortalecimiento de los Servicios Públicos, con el principal objetivo de lograr una gestión de las políticas de empleo que sea moderna, eficaz, eficiente e inclusiva y que dé respuesta a los requerimientos que llegan desde el nuevo contexto socioeconómico.
En tal sentido, este nuevo marco regulador pretende dar respuesta a los espacios de anomia y autorregulación que se venían produciendo en materia de intermediación. Al análisis de su alcance y de su contenido se dirige el presente estudio
The constitutional recognition of the right to work entails, among other aspects, the consideration of employment as a public activity or service. This does not prevent such activity from being provided both in its forms of direct management - through state or regional public employment services - or indirectly - through recourse to private initiative -, and all of this presided over by the principle collaboration with the public. Such a relationship of cooperation between subjects involved in the intermediation activity is part of the new Law 3/2023, on Employment, in any case, on the strengthening of Public Services, with the main objective of achieving management of employment policies that be modern, effective, efficient and inclusive and that responds to the requirements that arise from the new socioeconomic context. In this sense, this new regulatory framework aims to respond to the spaces of anomie and selfregulation that have been occurring in terms of intermediation. The present study is directed to the analysis of its scope and content.
