El TEDH ha condenado a Suiza por vulneración del CEDH. Entiende el TEDH que la inacción del Estado ha puesto en riesgo el derecho a la vida privada y familiar de los miembros de la asociación demandante, incumpliendo así las obligaciones positivas que se derivan del referido derecho.
Además de esta novedosa interpretación del artículo 8 del CEDH, la sentencia contiene pronunciamientos y criterios procesales de gran relevancia para el futuro de la litigación climática
The ECtHR has condemned Switzerland for violating the ECHR. The ECtHR has considered that Switzerland’s inaction on climate change has put the right to respect for private and family life of the members of the claimant’s association at risk and thus has failed to fulfil the positive obligations arising from that right.
In addition to this innovative interpretation of Article 8 of the ECHR, the judgment contains statements and procedural criteria of great significance for the future of climate litigation.
