En el marco de un amparo, un ciudadano rosarino solicitó que se tomarán medidas tendientes para que se fiscalicen periódicamente las frutas, verduras y hortalizas que ingresan desde otras jurisdicciones a los Mercados de Concentración Fisherton y de Productores de Rosario, a fin de evitar y controlar la presencia de biocidas, plaguicidas y otros agrotóxicos.
Mediante recurso extraordinario federal, la Corte Suprema de Justicia de la Nación, remitiéndose al dictamen de la Procuradora General de la Nación, se expresó en relación a las competencias en materia de aplicación del Código Alimentario Nacional y sobre las atribuciones del poder judicial a la hora de ordenar determinadas inspecciones y controles en cabeza del Senasa, sin afectar la división republicana de poderes, cuando hay un derecho constitucional en juego, en este caso el derecho a salud.
