Este escrito tiene por objeto identificar los principales cambios que ha sufrido el artículo 241 superior, en el que se señalan “taxativamente” las funciones de la Corte Constitucional como guardián supremo de la Carta. Estos cambios han tenido lugar por vía de actos legislativos y de pronunciamientos de la Corte Constitucional. A través de ellos se ha transformado la función de la Corte Constitucional ampliando su radio de acción de forma significativa. Describe tales cambios con el ánimo de someter a discusión el alcance, deliberado o necesario, de un órgano encargado de decir qué dice y cómo debe entenderse la Constitución, más allá de lo dispuesto por el poder constituyente primario.
The purpose of this document is to identify the main changes that the superior article 241 has undergone, in which the functions of the Constitutional Court as supreme guardian of the Charter are “taxatively” indicated. These changes have taken place through legislative acts and pronouncements of the Constitutional Court. Through them the function of the Constitutional Court has been transformed, expanding its scope of action significantly. It describes such changes with the aim of subjecting to discussion the scope, deliberate or necessary, of a body in charge of saying what the Constitution says and how it should be understood, beyond what is established by the primary constituent power.
