El artículo analiza un evento de prohibición de estacionamiento y discute la coherencia de la infracción con los propósitos de la ley de tránsito. Desde allí, establece la discordancia de esa infracción con el derecho constitucional a la libre circulación, al igual que con el derecho a estacionarse, respecto del cual sostiene es una derivación necesaria del derecho fundamental de locomoción. El estudio debate y argumenta sobre los objetivos de la ley, la ausencia de antijuridicidad material, la justedad de la infracción y otros aspectos, para demostrar que existe una vulneración al derecho constitucional a la libre circulación y un caso de abuso de poder.
The article analyzes a parking ban event and discusses the consistency of the violation with traffic law purposes. From there, it establishes the inconsistency of this in fraction with the constitutional right to free movement, as well as with the right to park, regarding which it maintains is a necessary derivation of the fundamental right of locomo tion. The study debates and argues about the objectives of the law, the absence of material unlawfulness, the justness of the infringement and other aspects, to demonstrate that there is a violation of the constitutional right to free movement and a case of abuse of power.
