El presente artículo propone profundizar el significado del principio de solidaridad intergeneracional en el sistema de pensiones, partiendo de la identificación del valor constitucional del vínculo de la solidaridad social entre las generaciones para después pasar al análisis de los relativos posibles criterios para su aplicación. Tras reconstruir las diversas opiniones que también han alimentado el debate sobre el tema, el artículo examina la coherencia de la disciplina en materia de pensiones con respecto a la solidaridad intergeneracional y el papel que este principio ha asumido en los pronunciamientos con los que el Tribunal Constitucional italiano ha valorado la legitimidad constitucional de las recientes medidas legislativas para controlar el gasto en pensiones.
The article aims to explore the meaning of the principle of intergenerational solidarity in the pension system, starting from the identification of the constitutional value of the obligation of social solidarity between generations and then moving on to the analysis of possible criteria for its implementation. After reconstructing the various opinions that have also inspired the debate on the subject, the article examines the consistency of the pension discipline with respect to intergenerational solidarity and the role that this principle has assumed in the pronouncements with which the Italian Constitutional Court has assessed the constitutional legitimacy of recent legislative interventions to contain pension expenditure.
