Al hilo del principio de libre circulación de trabajadores se plantea el problema de reconocer o no las prestaciones sociales, pues no quedan claras las fronteras entre Seguridad Social y Asistencia Social. La difícil tarea de deslinde entre uno y otro propicia que las fronteras entre ambas se hayan desdibujado. De igual modo, tampoco resulta nada fácil definir los conceptos de prestaciones contributivas y no contributivas, de ahí que para saber si una prestación se encuentra o no incluida en el campo de aplicación de los Reglamentos de coordinación los tribunales hayan de guiarse por el principio de condición más favorable (artículo 48 del TFUE). Siendo, por tanto, reconocidas como tales aquellas concedidas legalmente a sus beneficiarios y referidas a alguno de los riesgos que recogen los Reglamentos de Coordinación comunitaria.
The principle of free movement of workers raises the question of whether social benefits are recognized, since the boundaries between social security and social assistance are not clear.
