El fenómeno migratorio es una realidad compleja y proteiforme: constituye un “hecho social total”. Inevitablemente, las políticas del Derecho también lo son, pues han de atender a la complejidad de la realidad social sin ser un mero reflejo de ella: políticas de inmigración y de emigración (oscilantes o cíclicas en su variabilidad y desenvolvimiento); migraciones por razones de persecución o por causas principalmente económicas; políticas de integración/inclusión en las diversas vertientes socio-laborales, económicas, culturales, políticas y jurídicas en el enfoque y “lenguaje de los derechos”, lo que nos lleva no sólo a grandes declaraciones ideales y morales de justificación, sino también, y ante todo, a normas internacionales y constitucionales que los garantizan e imponen (y no solo legitiman) deberes de acción positivas de actuación de los poderes públicos internacionales y estatales. Las migraciones constituyen un exponente privilegiado para captar la entidad las transformaciones sociales, culturales e institucionales que se están produciendo en las sociedades fragmentadas del capitalismo tardío en un contexto transnacionalizado.
The migratory phenomenon is a complex and proteiform reality: it constitutes a “total social fact”. Inevitably, the policies of the Law are also so, since they have to attend to the complexity of the social reality without being a mere reflection of it: immigration and emigration policies (oscillating or cyclical in their variability and development); migration for reasons of persecution or mainly economic causes; integration/inclusion policies in the various socio-labor, economic, cultural, political and legal aspects in the approach and “language of rights”, which leads us not only to great ideal and moral declarations of justification, but also, and above all, to international and constitutional norms that guarantee them and impose (and not only legitimize) positive duties of action on the part of international and state public authorities. Migrations constitute a privileged exponent to capture the entity of the social, cultural and institutional transformations that are taking place in the fragmented societies of late capitalism in a transnationalized context.
