Este artículo trata sobre el conflicto que existe entre el derecho-deber del secreto profesional de los abogados en Chile y el control por parte de la autoridad pública del lavado de activos. Se expone el actual encuadre normativo del problema, mostrando las razones para limitar el secreto profesional del abogado, las complejidades de esta tarea y los actuales mecanismos de control en nuestro país.
The obligation of lawyers to keep confidential the information that their clients have entrusted to them for the defence of their interests may be in opposition to the legitimate interest of the public authority in accessing such information to prevent and sanction money laundering. This potential opposition has not been expressly resolved in our legal system, as there is some dissonance between recommendations 21, 22 letter d and 23 letter a of the Financial Action Task Force and the provisions of Law 19.913 in its articles 2 b fine and 33. However, a careful reading of the provisions currently in force shows that, at least in some cases, it is possible to affirm that the disclosure by lawyers of confidential information (tipping off) should not be legally sanctioned
