Society experiences significant changes that questions traditional judicial method of conflict resolution, for not being able to satisfactorily answer questions under its responsibility, either because of the time spent for judgment, or because of the decision that, in fact, does not reach the objective and continues to exist dissatisfaction that generates new conflicts. With the intention of contributing to a more comprehensive reflection on the context in question, this study, based on the systemic view of Law, intends to present systemic constellations as an alternative means of conflict resolution, capable of meeting the constitutional guarantee of access to justice and improve formal practices already developed by the Judiciary. Based on the systemic perception, based on the general theory of systems, a phenomenological posture, using the empirical-intuitive method, a reflection is presented on the possibility of implementing such a posture in legal conflicts, through the Systemic Constellations and obtaining a consensual and satisfactory individually and collectively.
A sociedade vivencia mudanças significativas que questionam o método judicial tradicional de resolução de conflitos, por não conseguir responder satisfatoriamente questões sob sua responsabilidade, quer seja pelo tempo despendido para julgamento, quer seja pela decisão que, faticamente, não alcança o objetivo e continua a existir insatisfação e novos conflitos. Com a intenção de contribuir para reflexão mais abrangente sobre o contexto em questão, o presente estudo, pautado na visão sistêmica do Direito, intenciona abordar as Constelações sistêmicas como meio alternativo de solução de conflitos, capaz de atender à garantia constitucional de acesso à Justiça e aprimorar as práticas formais já desenvolvidas pelo Poder Judiciário. A partir da percepção sistêmica, sob fundamento da teoria geral dos sistemas, postura fenomenológica, com a utilização do método empírico-intuitivo, apresenta-se reflexão sobre a possibilidade de implementar tal postura nos conflitos jurídicos, mediante as Constelações Sistêmicas e obter resolução consensual e satisfatória individual e coletivamente.
