The school environment is a social space of pluralism and respect for the freedom of distinct thoughts, where the citizen formation of a child actually takes place, so tolerance must be evident there. In this context, a research analyzes whether the binomial of state secularism and religious freedom was respected in the confessional model established by ADI 4439, examining the general historical context to which the separation between state and religion belongs, as well as the way religious education has been explored in the Brazilian scenario. Finally, he points out the correlation between the votes of the ministers in the aforementioned trial. The purpose of this study is to seek to clarify whether the confessional model, now guaranteed in ADI No. 4439, is in fact in total harmony with the constitutional precepts assured by the Major Charter.
O ambiente escolar é um espaço social de pluralismo e respeito à liberdade de pensamentos distintos, onde acontece de fato a formação cidadã de uma criança, logo, deve-se evidenciar ali a tolerância. Nesse contexto, dada pesquisa analisa no âmbito jurídico se o binômio laicidade estatal e consagração da liberdade religiosa foi respeitado no modelo confessional assentado pela ADI 4439, esmiuçando o contexto histórico geral a que pertence a separação entre Estado e Religião, bem assim o percorrer da educação religiosa no cenário brasileiro. Por fim, pontua a correlação entre os votos dos ministros no referido julgado. O objetivo desta pesquisa é buscar esclarecer se o modelo confessional, ora garantido na ADI n° 4439, está de fato em total harmonia com os preceitos constitucionais assegurados pela Carta Maior.
