This article aims to identify and discuss the meanings of the right to development since the Federal Constitution of 1988 (CF/88). The study is justified to the extent that the right to development assumes distinct conceptions and contents in each of the national states by which it is received, and some countries do not even understand it as a right. It is known that the right to development at the international level -as with every positivized human right of this order -has consecrated only basic universal values, from which it is never very easy to think about its legal and normative expansion, which also points in the direction of greater density in relation to the content of this right at the domestic level. Based on bibliographical and documental research, the present article aims, therefore, to identify and discuss the meanings of the right to development provided for in the Federal Constitution of 1988, especially from its principles and fundamental rights, which will enable reflection on the extension of the platform of fundamental rights. The contribution intends to offer, through the analysis, a theoretical reference for the study of the right to development in a broader and more systematic perspective.
O presente artigo tem por objetivo identificar e discutir as acepções do direito ao desenvolvimento a partir da Constituição Federal de 1988 (CF/88). O estudo se justifica na medida em que o direito ao desenvolvimento assume concepções e conteúdos distintos em cada um dos Estados nacionais pelos quais é recepcionado, sendo que alguns países sequer o compreendem enquanto direito. Sabe-se que o direito ao desenvolvimento no plano internacional – assim como todo direito humano positivado nesta ordem – consagrou apenas valores universais básicos, a partir dos quais nunca é muito se pensar em sua expansão jurídico-normativa, o que também aponta na direção de uma maior densidade em relação ao conteúdo deste direito nos planos internos. A partir de pesquisa bibliográfica e documental, o presente artigo tem por objetivo, portanto, identificar e discutir as acepções do direito ao desenvolvimento previstas na Constituição Federal de 1988, em especial a partir de seus princípios e direitos fundamentais, o que permitirá uma reflexão sobre a extensão da plataforma de direitos fundamentais. A contribuição pretende oferecer, pela análise, um referencial teórico para o estudo do direito ao desenvolvimento numa perspectiva mais ampla e sistemática.
