The study unveils interrelationships between the methodology of legal research and the Theory of Law, contemporary for an accurate definition of Theory of Knowledge and the adequate positioning of the researcher. From the understanding of knowledge in its historical, axiological and semiotic specificities, the concept is personalized by the contemporary man, under technical and deterministic influence, as a participant and active subject of the environment. In this way, the humanistic knowledge undertaken in a virtuous way in the current times is sought, with its ethical dilemmas and threats to the maintenance of social dynamics before the economic and social model in postmodernity. Methodologically, through the exposure of such contemporary conceptual metaphysical conflicts of the legal phenomenon, one starts to search for new values for an effective fullness of human dignity -in a multicultural perspective -, aiming at the absorption of secular knowledge and evolving historical learning axiological for future generations, through science and research -proposing the positioning of legal research in an updated conception of the professional and researcher of law, in face of the new emerging rights and the society of the 21st century.
O estudo desvela interrelações entre a metodologia da pesquisa jurídica e a Teoria do Direito, contemporânea para uma definição acurada de Teoria do Conhecimento e o posicionamento adequado do pesquisador. A partir da compreensão do saber em suas especificidades históricas, axiológicas e semióticas, parte-se para o conceito personalizado pelo homem contemporâneo, sob influência tecnicista e determinística, enquanto sujeito participante e atuante do meio. Dessa forma, procura-se o saber humanista empreendido de forma virtuosa nos tempos atuais, com seus dilemas éticos e ameaças para a manutenção das dinâmicas sociais ante o modelo econômico e social na pós-modernidade. Metodologicamente, por meio da exposição de tais conflitos metafísicos conceituais contemporâneos do fenômeno jurídico parte-se para a busca por novos valores para uma plenitude efetiva da dignidade humana – na perspectiva multicultural -, visando-se a absorção dos conhecimentos seculares e aprendizagem histórica em evolução axiológica para as futuras gerações, por meio da ciência e da pesquisa - propondo-se o posicionamento da pesquisa jurídica numa concepção atualizada do profissional e pesquisador do direito, face aos novos direitos emergentes e a sociedade do século XXI.
