    This work investigates the terms of the Brazil –Holy See Agreement, its constitutionality, its purpose and indispensability for the preservation of fundamental Humans Rights, especially religious freedom and the right to education. In order to do so, the documentary and comparative method is adopted, examining the terms of the treaty, the international and internal order of the parties, aided by doctrine and jurisprudence.

    O presente trabalho investiga os termos do Acordo Brasil – Santa Sé, a sua constitucionalidade, a sua finalidade e imprescindibilidade para a preservação de direitos humanos fundamentais, especialmente a liberdade religiosa e o direito à educação. Para tanto, adota-se o método documental e comparativo, examinando-se os termos do tratado, o ordenamento internacional e o interno das partes, auxiliado pela doutrina e pela jurisprudência.
