The Italian legal philosopher Norberto Bobbio denies that the discourse on the foundation of human rights has validity today. This study aims to analyze the arguments used by this thinker, asking if this issue was really backed because of the primacy of achieving these rights. Seeks to clarify the role that has a rational justification and its relation to the effectiveness and relevance of the reasons alleged by the philosopher to the abandonment of such reasons. Refuses the idea that the product of intellectual thinkers laboratory practice no influence. As a result, it is argued that the philosophy / practice dichotomy does not apply to human rights discourse.
O jusfilósofo italiano Norberto Bobbio nega que o discurso sobre a fundamentação dos direitos humanos tenha validade, hoje. O presente trabalho tem por objetivo analisar a argumentação utilizada por esse pensador, indagando se esta problemática foi realmente secundada em virtude da primazia da concretização desses direitos. Busca-se aclarar o papel que uma justificação racional possui e sua relação com a efetividade e a pertinência dos motivos alegados pelo filósofo para o abandono dessa fundamentação. Nega-se a ideia de que o produto do labor intelectual dos pensadores não influencia a prática. Em conseqüência, defende-se que a dicotomia filosofia/ prática não se aplica ao discurso dos direitos humanos.
