A polarização política sempre foi um dos pontos importantes para formação de movimentos discriminatórios. O Brasil está vivenciando um momento histórico na sua recém restaurada caminhada democrática. A política partidária gerou uma das eleições mais acirradas da história. Esta grande oportunidade carrega consigo o desafio de como lidar com esta tensão; como bem gerar mecanismos para que esta não se articule em intolerância, racismo e discriminação. No presente artigo, busca-se dar uma visão de uma possível solução institucional para este problema. Propõem-se tratar do tema por uma perspectiva internacional e de construção de estruturas legais que possam distender e defletir a dificuldade e, se necessário, pará-la na sua origem ou mesmo puni-la a posteriori. O objetivo é comentar sobre as Convenções Interamericanas Contra o Racismo, a Discriminação Racial e Formas Correlatas de Intolerância; e Contra Toda Forma de Discriminação e Intolerância como mecanismos de promoção da não-discriminação e igualdade.
The political polarization was always one of the important points for formation of discriminatory movements. Brazil is living a historical moment in itsrecently restored democratic way. The party politics generated one of the most intransigent electionsof the history. This great opportunity carries with itselfthe challenge of howto deal with this tension; as well to generate mechanisms so that this doesn't articule in intolerance, racism and discrimination. In the present article, we seek to give a vision of a possible institutional solution for this problem. We intend to treat the issue by an international perspective and construction of legal structures that can distend and deflect the difficulty and, if necessary, to stop it in its origin or even topunish it aposteriori. The goal is to comment on about the Interamerican Conventions Against Racism, Racial Discrimination and Forms Correlate of Intolerance; and Against every Form of Discrimination and Intolerance as mechanisms of promotion of the no-discrimination and equality.
