The work is a reinterpretation of contract and seeks to draw a functional and a promotional profile of the institute, seeking a contract design that expresses the constitutional principles. The study of the subject will seek to demonstrate that the contract no longer fits into an individualistic frame who seeks only the satisfaction of the interests of the parties. The contractual model that is proposed is one in which also contains the concern with a solidaristic purpose that guides the constitutional system. The work will address briefly the historical evolution of the contract and will examine the roles it should play in contemporary society, especially the social function. In this context, will be examined the dynamics of the contractual relationship that connects directly to society and to the environment. Thus, permeating the social function of the contract, it defends the idea that the contract is an instrument that should reflect the solidaristic ideals of the constitutional order and that should collaborate for the sustainable development.
O trabalho faz uma releitura do contrato e procura traçar um perfil funcional e promocional do instituto, em busca de um desenho contratual que exprima a principiologia constitucional. O estudo do tema procurará demonstrar que o contrato não cabe mais em uma moldura individualista que procura a satisfação apenas de interesses das partes. O modelo contratual que se propõe é aquele em que está presente também a preocupação com uma finalidade solidarista que orienta o ordenamento constitucional. O trabalho abordará de forma breve a evolução histórica do contrato e analisará as funções que deve desempenhar na contemporaneidade, em especial a função social. Nesse contexto, será examinada a dinamicidade da relação contratual que a conecta diretamente à sociedade e ao meio ambiente. Dessa forma, permeando a função social do contrato, defende-se a ideia de que o contrato é instrumento que deve espelhar os ideais solidaristas da ordem constitucional e que deve colaborar para o desenvolvimento sustentável.
