The article aims to analyze the structural construction of fundamental rights, more precisely how their contours are operated. Thus, the main theoretical currents on the topic are broached, from the theoretical framework of the Jurisprudence of Values (Wertungsjurisprudenz). The existence of an essential content of these rights passes necessarily by normative conceptionsof existential minimum and the factual requirements of the reserve of possible. Within this framework, the reification of standing values as ineliminable jusfundamentals limits remain a voluntarist stance, not appropriate to the dynamics of permanent conformation of Law to reality.
O artigo objetiva analisar a construção estrutural dos direitos fundamentais, mais precisamente como se operacionalizam seus contornos. Desse modo, são abordadas as principais correntes teóricas sobre o tema, a partir do marco teórico da Jurisprudência dos Valores (Wertungsjurisprudenz). A existência de um conteúdo essencial desses direitos perpassa necessariamente pelo tensionamento entre concepções normativas de mínimo existencial e os imperativos fáticos e jurídicos da reserva do possível. Nesse quadro, a reificação de valores estanques como limites jusfundamentais inelimináveis resta uma postura voluntarista, pouco apropriada à dinâmica de conformação permanente do Direito à realidade.
