This paper aims to examinethe process, observed the constitutional theory, as a guarantee of fundamental rights in a democratic state. To do so, it will examine the concept of fundamental rights and guarantees, making the necessary distinction between these, as well as differentiating the fundamental rights of human rights. Later, there will be a brief assessment of the concept of a democratic state and its main features, theoretical framework of this study. Following will analyze the constitutional model of processand the ruptureof the process general theory with the theory of legal relationshipfromBülow and Liebman. For the last, to finish the study, the main issue will be addressed, namely, the constitutional process as guaranteed fundamental right in a democratic state, based on the issues previously discussed, aimingto getaway from the notion that the judge is responsible for the promotion of social justice and therefore combating judicial activism. For thepresent study, we will use the literature search and the deductive method, starting with a macro to a micro analytic design on the subject now under study and, finally, as a technical procedure thematic analysis, theoretical and interpretive seeking suggestions for resolving the outstanding issue.
O presente trabalho tem por objeto a análise do processo, observada a teoria constitucionalista, como forma de garantia dos direitos fundamentais no Estado Democrático de Direito. Para tanto, analisar-se-á o conceito de direitos e garantias fundamentais, fazendo a necessária distinção entre estes, bem como diferenciando os direitos fundamentais dos direitos humanos. Posteriormente, será feita uma breve apreciação do conceito de Estado Democrático de Direito e suas características principais, marco teórico do presente trabalho. Após, será analisado o modelo constitucional de processo e a ruptura da teoria geral do processo com a teoria da relação jurídica de Bullow e Liebman. Por derradeiro, para finalizar o estudo, será abordada a questão principal, qual seja, o processo constitucional como garantia de direito fundamental no Estado Democrático de Direito, a partir das questões anteriormente debatidas. Para o presente estudo, utilizar-se-á a pesquisa bibliográfica e o método dedutivo, partindo-se de uma perspectiva macro para uma concepção micro analítica acerca do tema ora em estudo e, por fim, como procedimento técnico a análise temática, teórica ePesquisa Bibli interpretativa, buscando sugestão para a solução da questão destacada.
