This article aims to analyze the relationship of Legal Policy with New Legal Hermeneutics. Notes the relationship between the two disciplines from acting as the operator of the Judge’s law. This uses the referents of justice, ethics and social utility of the law, proposed by the Legal Policy, and techniques of interpretation identi ed by Legal Hermeneutics, to apply a rule to the concrete fact. Founded in its discretion not only aims to derive the rules contained in codes positivized, but also create new interpretations, to break with the paradigms and lead to even put the debate on certain controversial issues. The interconnection between these disciplines is crucial to the emergence of a new legal culture because, currently, there is a legal thought focused on the development of a knowledge that not only look accurate, sure, but above all Justice, Ethics and Utility Social Law.
O presente artigo tem por objetivo analisar a relação daPolítica Jurídica com a Nova Hermenêutica Jurídica. Observa-se arelação entre as duas disciplinas a partir da atuação do Juiz enquantooperador do direito. Este recorre aos referentes de Justiça, Eticidadee Utilidade Social do Direito, propostos pela Política Jurídica, e àstécnicas de interpretação apontadas pela Hermenêutica Jurídica,para aplicar a norma ao fato concreto. Fundado em seu poderdiscricionário objetiva não só auferir as normas contidas nos códigospositivados, mas também de criar novas interpretações, romper comos paradigmas postos e provocar mesmo o debate sobre certos temaspolêmicos. A interconexão entre estas disciplinas é fundamentalpara que surja uma nova cultura jurídica, pois, atualmente, existeum pensamento jurídico voltado à elaboração de um saber que nãobusque apenas a precisão, a certeza, mas acima de tudo a Justiça, aÉtica e a Utilidade Social do Direito.
