Teses básicas do positivismo e suas críticas ao jusnaturalismo

    Underlying the text it appears the idea that jusnaturalism and juspositivism are two theories and antithetical positions in reciprocal tension, reference and reformulation, which leads to new meanings. The text reflects the historical conceptions of jusnaturalism and centers upon the reviews (or criticisms) formulated by the classical juspositivists [ROSS, HART, and KELSEN] from the point of view of the distinguishing features of their conceptions and the exposition of the basic theses of legal positivism. The criticisms that were formulated, although deriving from certain interpretations of Nature, do not disqualify the function and the critical dimension of the natural law neither the consistency of human nature as the fundamentals of natural or positive law.

    Subjaz ao texto a ideia de que jusnaturalismo e juspositivismo são duas teorias e  posicionamentos antitéticos em tensão, referência e reformulação recíprocas, razão dos   respectivos e novos sentidos. O texto reflete as concepções históricas do jusnaturalismo e centra-se nas críticas que lhes foram formuladas pelos positivistas clássicos  [ROSS, HART e KELSEN] a partir da especificidade de suas concepções e na exposição das teses básicas do positivismo. As criticas formuladas, embora procedentes em relação a certas interpretações da natureza, não desqualificam a função e dimensão crítica do direito natural, nem a consistência da natureza humana como fundamento do direito natural e  positivo.
