This article proposes a reflection on the socio-environmental impact of the construction oftheJosé BoiteuxNorth Dam on Xokleng Indigenous Land, located in the southern region of Brazil. The dam project aims to meet the flood containment needs of Vale do Itajaí and the region; however, it raises concerns about its socio-environmental impact, especially on the Xokleng indigenous communities that inhabit the area. This articleaimsto analyze the implications of José Boiteux North Dam, the challenges and conflicts of interest between economic development and environmental preservation, the territorial rights of indigenous people,and the impact on Xokleng's life and culture. Considering this approach, the question is: how does the construction and operation of José BoiteuxNorth t Dam impact climate justice and human rights, particularly the rights of the Xokleng Indigenous community, and what are the socio-environmental implications of this intervention? As forthe methodological aspects, the theoretical work used the hypothetical-deductive approach, using bibliographical and documentary research with indirect data collection and legal interpretation with a sociological bias. It concludes by demonstrating and highlighting the need for ecological and sustainable approaches to dealing with such socio-environmental dilemmas.
