A principios del siglo XVIII, un malacitano, catedrático de prima de Leyes en la Universidad de Salamanca, redactó un tratado académico sobre las missiones in possessionem rei servandae causa, con enunciado de doce tesis para defender en debate matutino y vespertino. Defiende que solamente otorga la detentación del bien, aunque está protegida por el pretor. Se concede para conseguir la comparecencia del reo, a efectos de la litis contestatio, bien porque se oculta maliciosamente o porque es contumaz, siempre que no retorne al proceso y pague las expensas, es decir, asuma la defensa del litigio.
At the beginning of the 18th century, a professor of Law at the University of Salamanca -born in Malaga- wrote an academic treatise on the missiones in possessionem rei servandae causa, with a statement of twelve dissertations to be defended in morning and evening debates. He argues that it only grants possession of the property, although it is protected by the praetor. It is granted to obtain the appearance of the defendant for the purposes of the litis contestatio, either because he is maliciously hiding, or because he is contumacious, provided he does not return to the process and pays the expenses.
