Desde la fundación de la República Popular China, y con el avance de las reformas económicas y sociales, su sistema legal ha experimentado cambios significativos, especialmente en el ámbito del turismo. Este artículo analiza en detalle la evolución de las leyes relacionadas con el turismo en el país asiático, con un enfoque particular en la Ley de Turismo promulgada en 2013 y el Código Civil de 2020, y su impacto en la regulación de la industria turística y las viviendas de uso turístico. El artículo explora cómo la legislación nacional y local, incluidas las normativas administrativas y las regulaciones sobre el uso del suelo y la planificación urbana, afectan el desarrollo del turismo y la conversión de propiedades residenciales en inmuebles de uso turístico. A través de una revisión de la literatura y el análisis del marco regulatorio vigente, esta investigación examina los desafíos legales que enfrenta la industria turística y las viviendas de uso turístico en China.
Since the founding of the People's Republic of China, and with the advancement of economic and social reforms, its legal system has undergone significant changes, especially in the field of tourism. This article analyzes in detail the evolution of tourism-related laws in the Asian country, with a particular focus on the Tourism Law enacted in 2013 and the 2020 Civil Code, and their impact on the regulation of the tourism industry and tourist-use dwellings. The article explores how national and local legislation, including administrative regulations and regulations on land use and urban planning, affect tourism development and the conversion of residential properties into tourist-use real estate. Through a literature review and analysis of the current regulatory framework, this research examines the legal challenges facing the tourism industry and tourist-use housing in China.
