En las actuales circunstancias no es suficiente con disponer de un sistema pro-cesal eficaz; además es preciso que sea sostenible económicamente y, por supues-to, eficiente. Las razones de esta situación son muy diversas y obedecen a cau-sas muy distintas. El autor analiza en este trabajo las últimas medidas adoptadas por el gobierno para paliar esta situación, tanto aquellas que tienen por objeto adaptar el funcionamiento del proceso a las nuevas tecnologías ante los retos de la justicia y los desafíos de la era digital, como las más novedosas para afrontar la litigación en masa y otras específicas que tienen por objeto tratar de resolver el colapso que está producido en determinados juzgados las reclamaciones de los consumidores sobre cláusulas abusivas, como el procedimiento testigo o la refor-ma del juicio monitorio.
In den gegenwärtigen Umständen reicht es nicht aus, über ein wirksames Verfah-renssystem zu verfügen; es muss auch wirtschaftlich nachhaltig und natürlich effizi-ent sein. Die Gründe für diese Situation sind vielfältig und gehen auf verschiedene Ursachen zurück. Der Autor analysiert in dieser Arbeit die neuesten Maßnahmen der Regierung, um diese Situation abzumildern, sowohl jene, die darauf abzie-len, den Ablauf des Verfahrens an die neuen Technologien anzupassen, angesichts der Herausforderungen der Justiz und der digitalen Ära, als auch die neuesten Maßnahmen zur Bewältigung der Massenklagen und andere spezifische Maßnah-men, die darauf abzielen, das Kollabieren bestimmter Gerichte zu verhindern, die mit Verbraucherklagen über missbräuchliche Klauseln konfrontiert sind, wie die Modellklage oder die Reform des Mahnverfahrens.
In the current circumstances it is not enough to have an effective procedural sys-tem; it must also be economically sustainable and clearly efficient. The reasons for such situation are pretty diverse and due to very different factors. In this piece of work the author analyses the latest measures adopted by the government to alle-viate such situation, such which aim to adapt the operation of the process to new technologies in the face of the challenges of justice and the challenges of the dig-ital age, as well as the most innovative ones in order to face mass litigation and other specific measures which aim to try to resolve the collapse happening in cer-tain courts by claims of consumers against unfair contract terms, such as model cases (procedimiento testigo, in Spanish) or the reform of the order for payment procedure.
