La entrada en vigor del Protocolo de la Carta Africana de Derechos Humanos y de los Pueblos sobre los derechos de la mujer en África, marcó la culminación de años de lucha por un documento de promoción y protección de los derechos humanos de las mujeres del continente. Este trabajo proporciona una breve reseña histórica del proceso que condujo a la adopción del Protocolo por parte de la Unión Africana en Maputo en julio de 2003 antes de pasar a examinar sus disposiciones sustantivas, cuya aplicación se considera todavía repleta de obstáculos.
The entry into force of The Protocol to the African Charter on Human and Peo-ple’s Rights on the rights of women in Africa marked the culmination of years of struggle for a document for the promotion and protection of the human rights of women on the continent. This paper provides a brief historical overview of the pro-cess leading to the adoption of the protocol by the African Union in Maputo in July 2003, before moving into considering its substantive provisions, the implementa-tion of which is still considered to be fraught with obstacles.
Das Inkrafttreten des «Protokolls zur Afrikanischen Charta der Menschenrechte und der Rechte der Völker» bezüglich der Rechte der Frauen in Afrika markier-te den Höhepunkt jahrelanger Kämpfe für ein Dokument zur Förderung und zum Schutz der Menschenrechte der Frauen auf dem Kontinent. Diese Arbeit bietet einen kurzen historischen Überblick über den Prozess, der zur Annahme des Proto-kolls durch die Afrikanische Union im Juli 2003 in Maputo führte, bevor die mate-riellen Bestimmungen untersucht werden, deren Umsetzung noch als mit Hinder-nissen behaftet gilt.
