El presente trabajo es un conjunto de reflexiones sobre el término «bases de las obligaciones contractuales»; materia que el artículo 149.1.8ª de la Constitución reserva «en todo caso» al Estado y que sobre la que, tras casi cuarenta y seis años de vigencia del texto constitucional, sigue planeando la sombra del desconocimiento y la incertidumbre. A través de un estudio doctrinal y jurisprudencial, se busca arrojar algo de luz sobre un concepto sin delimitar en un sistema de reparto de competencias en materia de legislación civil tampoco delimitado.
This paper is a set of reflections on the «bases de las obligaciones contractuales». Articl 149.1.8ª of the Spanish Constitution reserves this matter «in any case» to the State and a shadow of uncertainty remains over it after forty-six years of the enactment of the Constitution. Through the study of authors' opinion and case law, the purpose of this paper is to shed some light on an undefined issue in an also undefined system of allocation of legislative powers in the field of civil law.
