En el contexto de la pospandemia, la administración de justicia, al haber atravesado un cambio de paradigma con el uso de las tecnologías de la información y comunicación, ha gestionado una nueva realidad ecléctica, manteniendo métodos tradicionales, pero implementado otros nuevos. En un caso, la Corte Suprema de Justicia de Argentina ha emitido un pronunciamiento en el que se hace mención a un principio de presencialidad del que emergen ficciones jurídicas que ameritan ser analizadas desde los axiomas de la celebración del juicio y lo establecido en la normativa adjetiva, destacando sus ventajas y desventajas.En el presente trabajo, contrastando la normativa argentina con los tratados internacionales al respecto, la normativa boliviana y los Principios de Bangalore sobre la conducta judicial, se replantea la verdadera teleología de las audiencias dentro del sistema garantista y todos los factores de interacción humana que implican la presencialidad como principio orgánico desde una mirada gnoseológica, en parangón con el prexistente principio de inmediación. Se pretende contestar, al menos en parte, a la pregunta de qué debe quedar del régimen que ha impuesto la pandemia, y si la presencialidad es un principio per se.
In the post-pandemic context, the administration of justice, having undergone a paradigm shift with the use of information and communication technologies, has managed a new eclectic reality, retaining traditional methods but also implementing and maintaining new ones. In a specific case, the Supreme Court of Justice of Argentina issued a ruling that mentions a principle of presence, from which legal fictions emerge, warranting analysis from the axioms of trial celebration and what is established in procedural regulations, highlighting its advantages and disadvantages.This document, discusses alignment with international treaties addressing this theme, contrasting it with Bolivian regulations and the Bangalore Principles on Judicial Conduct, and reconsiders the true teleology of hearings within the guarantee- based system and all the human interaction factors that presence implies as an organic principle from an epistemological perspective, comparing it with the pre-existing principle of immediacy. It aims to answer, at least in part, the question of what should remain from the regime imposed by the pandemic, and whether there is a principle of presence.
