El presente artículo realiza un análisis general del concepto de bien jurídico penal, entendiendo por tal el objeto merecedor de protección por parte del ordenamiento jurídico penal. Analiza su evolución histórica y sus diversas concepciones.
Define su contenido y las funciones que debe cumplir dentro del ámbito penal, así como una clasificación de los distintos bienes jurídico penales existentes, todo ello para analizar si sigue siendo un instrumento válido capaz de dar respuesta a los desafíos del Derecho penal
This paper analyzes the concept of criminal legal right, understanding as such the object deserving of protection by the criminal legal system. It analyzes its historical evolution and its various conceptions to highlight the challenges it has to respond to in today's society.
It defines its content and the functions it must fulfill within the criminal field, as well as a classification of the different existing criminal legal assets, all of this to analyze whether it continues to be a valid instrument capable of responding to the challenges of criminal law.
