Este artículo estudia las principales manifestaciones y expresiones de la "fundamentalidad" a medida que se hacen evidentes a) la capacidad de los derechos que la poseen para constituir el fundamento del sistema en el que se reconoce y, al mismo tiempo, para ser fundamentados por él; b) por la propiedad de la "fundamentalidad" para respaldar la inviolabilidad de los derechos; c) la capacidad de cada uno de esos derechos para servir también de base a los demás del mismo tipo; d) por el carácter de "fundamentalidad" como bisagra que permite la integración de varios ordenamientos jurídicos (y, en particular, el del Estado y el de la Unión Europea), gracias precisamente al reconocimiento de derechos de carácter omnicomprensivo, aunque estén sujetos a regulaciones en parte diferentes entre sí.
This article explores the main manifestations and expressions of ‘fundamentalism’ as they become evident a) the capacity of the rights that possess it to constitute the foundation of the system in which it is recognised and, at the same time, to be founded by it; b) by the property of ‘fundamentality’ to support the inviolability of rights; c) the capacity of each of these rights to also serve as a basis for others of the same type; d) because of its ‘fundamental nature’ as a hinge that allows the integration of several legal systems (and in particular that of the State and the European Union), thanks precisely to the recognition of rights of an all-encompassing nature, even if they are subject to regulations that are in part different from one another.
