A pesar de la existencia de un marco legal y jurídico, así como de procedimientos para la intervención de las Fuerzas Armadas durante los conflictos sociales, sigue siendo controversial su actuación. El presente artículo tuvo como propósito definir conceptos e ideas que permitan entender las responsabilidades y funciones inherentes a las Fuerza Armadas a la luz de la normatividad vigente. Se desarrolló desde un enfoque cualitativo; bajo una investigación de tipo documentalbibliográfico. Se realizó una revisión de la legislación nacional aplicable al tema, así como libros y artículos relevantes. Se analizó críticamente dichas fuentes; describiendo los hallazgos encontrados, permitiendo desarrollar el cuerpo teórico en relación al tema de estudio; para luego emitir un conjunto de argumentos y conclusiones relacionados a la investigación. Se concluyó que hay un abuzo en el uso de los estados de emergencia y que las Fuerzas Armadas deben evitar el enfrentamiento con la población, siendo lo más asertivo el cuidado de activos críticos y no la neutralización de las protestas. El entrenamiento y capacitación de las FF.AA. es vital porque disminuye los impactos negativos durante su intervención.
Despite the existence of a legal and juridical framework, as well as procedures for the intervention of the forces of order during social conflicts, their performance remains controversial. The purpose of this article was to define concepts and ideas that allow understanding the responsibilities and functions inherent to the Armed Forces in light of current regulations. It was developed from a qualitative approach; under documentary bibliographical research. A review of the national legislation applicable to the subject was carried out, as well as relevant books and articles. These sources were critically analyzed; describing the findings found, allowing the development of the theoretical body in relation to the subject of study; to then issue a set of arguments and conclusions related to the investigation. It was concluded that there is abuse in the use of states of emergency and that the armed forces should avoid confrontation with the population, the most assertive being the care of critical assets and not the neutralization of protests. The training and training of the armed forces is vital because it reduces the negative impacts during their intervention.
