Hoy la asociación patrimonio y turismo es frecuente y puede observarse como práctica política para el desarrollo sustentable, pero también como valor conferido de un pueblo al ambiente, a su cultura, a sus formas de actuar, y en general, de ser. El objetivo de este estudio es describir, desde un enfoque jurídico comparativo,las consideraciones normativas en materia de turismo para la preservación del patrimonio en el estado de Oaxaca, particularmente al contar con sitios declarados patrimonio de la humanidad y ser la actividadturística una estrategia de desarrollo para la entidad. La metodología empleada es descriptiva. Los principalesresultados son que de 12 categorías comunes de interés para la legislación turística mexicana en materia de patrimonio, Oaxaca sólo toma participación en cinco de ellas en su ley de turismo. A pesar de esto, se denota en su marco legal interés en la preservación y salvaguarda de su patrimonio. Se concluye necesario fortalecerel marco normativo la ley de turismo en Oaxaca a fin de una mayor garantía de la protección y preservación del patrimonio tangible e intangible en su territorio.
Today the heritage and tourism association is frequent and can be seen as a political practice for sustainabledevelopment, but also as a value conferred by people on the environment, their culture, their ways of acting and in general, of being. The objective of this study is to describe, from a comparative legal approach, the normative considerations in tourism for the preservation of heritage in the state of Oaxaca, particularly when having sites declared heritage of humanity and tourism being a strategy of development for the entity. The methodology used is descriptive. The main results are that of 12 common categories of interest for Mexican tourism legislation in matters of heritage, Oaxaca only participates in five of them in its tourism law. Despite this, its legal framework shows an interest in the preservation and safeguarding of its heritage. It is concludedthat it is necessary to strengthen the regulatory framework of the tourism law in Oaxaca in order to better guarantee the protection and preservation of the tangible and intangible heritage in its territory.
