En las siguientes páginas se analizan consecutivamente el auto de homologación de un plan de reestructuración dictado por el Juzgado de Primera Instancia (con funciones mercantiles) de Cáceres y la posterior sentencia de la Audiencia Provincial de Cáceres que resuelve las impugnaciones planteadas por los acreedores disidentes frente al auto de homologación. El interés de analizar ambas resoluciones de forma consecutiva reside en la importancia que tiene para los motivos de impugnación ante la Audiencia Provincial, la estructura y contenido del plan de reestructuración, por cuanto el primero de ellos se basa en la incorrecta delimitación del perímetro de afectación, y el segundo al test del interés superior del acreedor.
The following pages analyse consecutively the order of judicial recognition of a restructuring plan issued by the Court of First Instance (with commercial functions) of Cáceres and the subsequent judgment of the Provincial Court of Cáceres resolving the challenges raised by the dissenting creditors against the order of judicial recognition. The interest of analysing both rulings consecutively lies in the importance of the structure and content of the restructuring plan for the grounds of the challenges before the Provincial Court, insofar as the first of these is based on the incorrect delimitation of the perimeter of affectation, and the second on the test of the creditor's best interests.
