La desobediencia civil es una de las formas de participación política más drásticas y significativas a las que puede acudir un movimiento social para hacer valer sus pretensiones de justicia en la arena pública. Sin embargo, las conceptualizaciones clásicas de la desobediencia civil, en tanto que consideran que el uso de la violencia es radicalmente incompatible con este modo de protesta, han limitado el alcance de este fenómeno exclusivamente al contexto de las democracias occidentales. Así, en este trabajo se pretende analizar la relación entre desobediencia civil y violencia, tratando de determinar en qué contextos y bajo qué circunstancias está justificado el recurso a la violencia por parte del desobediente, argumentando que su justificación depende del sentido de justicia de la mayoría y del tipo de violencia percibida como aceptable en una determinada sociedad. Asimismo, se discute el uso de la violencia por parte de la autoridad política, examinando el papel del castigo y la represión para determinar de qué modo la desobediencia civil, como forma de participación política, debe mostrar fidelidad a la ley.
Civil disobedience is one of the most drastic and significant forms of political participation that a social movement can resort to in order to assert its claims to justice in the public arena. However, classical conceptualizations of civil disobedience, insofar as they consider the use of violence to be radically incompatible with this form of protest, have limited the scope of this phenomenon exclusively to the context of Western democracies. Thus, this paper seeks to analyze the relationship between civil disobedience and violence, trying to determine in what contexts and under what circumstances the use of violence by the disobedient is justifi ed, arguing that its justifi cation depends on the sense of justice of the majority and the type of violence perceived as acceptable in a given society. It also discusses the use of violence by political authority, examining the role of punishment and repression in determining how civil disobedience, as a form of political participation, must show fi delity to the law
