El Tribunal de Justicia con frecuencia reescribe las cuestiones prejudiciales enviadas por los tribunales nacionales en el seno del procedimiento para una cuestión prejudicial. Esta práctica suele denominarse reformulación e implica un cambio en la sustancia de la pregunta formulada (reformulación sustantiva). El Tribunal justifica el uso de la reformulación en la necesidad de dar una respuesta útil a los tribunales nacionales. Este artículo investiga empíricamente cómo el Tribunal de Justicia utiliza las aportaciones de las partes en la reformulación de la pregunta. A tal fin, el artículo construye un marco de análisis que permite observar la influencia de las partes en los cambios en la disputa, así como las justificaciones ofrecidas por el Tribunal. El análisis usa una base de datos de 380 sentencias del Tribunal.
El artículo concluye que el Tribunal recurre frecuentemente a la reformulación sustantiva. Al reformular la disputa, el Tribunal usa los materiales aportados por las partes, cuya influencia pueda trazarse en las respuestas del Tribunal. Sin embargo, la influencia de las partes en la reformulación no debe sobreestimarse, ya que el Tribunal mantiene el control completo sobre cuándo y cómo reformular. No es fácil identificar patrones de uso de la reformulación sustantiva. Proporcionar una respuesta útil es una excusa conveniente, pero no parece explicar plenamente el recurso a esta práctica. El artículo ofrece una discusión sobre otras razones detrás de la reformulación de preguntas.
The Court of Justice frequently redrafts the questions submitted to it by the national courts in the context of the preliminary reference procedure. The practice is known as reformulation, and oftentimes determines a change to the substance of the question, which is referred to in this article as substantial reformulation. The Court justifies its use in the need to provide a useful answer to the national court. This article empirically investigates how the Court uses the submissions of the parties and other materials in the case to reformulate substantially. To do so, the article builds a framework of analysis to observe the possible influence of the parties in the changes to the dispute and the justifications used by the Court. The analysis relies on a unique dataset of 380 hand-coded preliminary rulings on interpretation. The findings confirm that substantive reformulation at the Court is frequent and significant. In reformulating the dispute, the Court draws on the materials submitted by the parties, and their influence can be traced to the questions actually replied to by the Court. Yet, the influence of the parties in setting the boundaries of the dispute must not be overstated, as it remains fully within the Court’s control when to reformulate and which materials to use to do so. Furthermore, it is difficult to identify patterns in the Court’s use of substantial reformulation. Providing a sufficient answer is a convenient excuse, but it does not seem to fully explain the findings of the article. The article explores other possible explanations for the increasingly frequent revert to reformulation.
