El presente trabajo propone un análisis del cuento “Emma Zunz” de Jorge Luis Borges, a partir de las contribuciones del denominado movimiento “derecho y literatura”. En efecto, se abordará la obra, en primer lugar, mediante la identificación de las presencias jurídicas en la construcción de la narrativa ficcional, destacando, sobre todo, la significación en la época en la que transcurren los hechos.
Por otro lado, el estudio se detendrá en aquello que Emma Zunz enseña al mundo del derecho, entendiendo enseñar como mostrar, es decir, las formas en que la literatura designa lo innombrable, articula el deseo, el poder y el cuerpo, asuntos de trascendencia fundamental para pensar la subjetividad jurídica.
This paper proposes an analysis of Jorge Luis Borges’ short story “Emma Zunz” based on the contributions of the so-called “law and literature” movement.
In fact, the work will be approached, first and foremost, by identifying the legal elements in the construction of the fictional narrative, highlighting, above all, their significance in the time in which the events take place.
On the other hand, the study will focus on what Emma Zunz teaches the world of law, understanding teaching as showing, that is, the ways in which literature designates the unnamable, articulates desire, power, and the body, issues of fundamental importance for thinking about legal subjectivity.
