Una correcta interpretación del género de la novela que aspire a ser útil para el movimiento Derecho y Literatura debe tomar en consideración las propuestas de la Teoría de la Novela. Del análisis de los planteamientos teóricos sobre la novela de autores como Fielding, Hegel, Lukács, Adorno o Bajtín se extraen elementos que permiten hacer de la experiencia de la lectura un instrumento para mejorar la posición del ser humano en el conjunto normativo de su cultura. Como ejemplo de este tipo de análisis se estudia la novela romántica de finales del siglo XIX y comienzos del siglo XX.
A correct interpretation of the genre of the novel that aspires to be useful for the Law and Literature movement must take into consideration the proposals of the Theory of the Novel. From the analysis of the theoretical approaches on the novel by authors such as Fielding, Hegel, Lukács, Adorno or Bakhtin, elements are extracted that make the experience of reading an instrument to improve the position of human beings in the normative set of their culture. As an example of this type of analysis, the romantic novel of the late 19th century and early 20th century is studied.
