El objetivo del presente artículo consiste en analizar el rol del Instituto Nacional de Acceso a la Información y Protección de Datos Personales (INAI). ¿En qué medida el Consejo Consultivo del INAI incentiva el fortalecimiento de este órgano para que las libertades ciudadanas sean protegidas cuando se afectan los derechos relacionados con el ejercicio de acceso a la información y la seguridad de los datos personales? La hipótesis que se plantea es que la tarea deliberativa y argumentativa del Consejo Consultivo es fundamental para enriquecer la toma de las decisiones por parte de los consejeros que integran el pleno del INAI, al observar, criticar y recomendar acciones que deben orientarse hacia una mejor aplicación de las disposiciones que aluden al derecho de acceso a la información y la protección de los datos personales, en un marco de protección y seguridad que se sustenta en la institucionalidad de los valores democráticos.
This article aims to analyze the role of the National Institute of Access to Information and Protection of Personal Data (INAI). To what extent does the Advisory Council of INAI encourage strengthening this body so that citizens' freedoms are protected when rights related to the exercise of access to information and the security of personal data are affected? The hypothesis put forward is that the deliberative and argumentative task of the Advisory Council is fundamental to enrich the decision-making by the councilors that make up the plenary of INAI by observing, criticizing, and recommending actions that should be oriented towards a better application of the provisions that allude to the right of access to information and the protection of personal data, within a framework of safety and security that is based on the institutionality of democratic values.
